Iraq Veteran Arrested For Legally Open-Carrying Rifle

This is unbelievable. An Iraq veteran and his son were on a Boy Scout hike when police detained him, disarmed, him, and arrested him for legally carrying a rifle. This video was sent to me on Twitter and I found it so offensive I honestly had to check to make sure it was legit. Todd Starnes wrote about it earlier today.

“In this day and age people are alarmed when they see someone with what you have,” one of the officers told a handcuffed Grisham. “They don’t care what the law is.”

Soon they will target open-carry. What gets me the most is to hear this man’s son crying as he videotapes his father being forced into a police cruiser for absolutely no reason.

What the police did was illegal as Grisham was legally carrying. United States v. DeBerry finds that stopping someone for legally carrying a firearm is illegal. Terry v. Ohio holds that Grisham’s Fourth Amendment rights were violated when his firearms were seized without sufficient reason to believe him guilty of a crime or about to commit a crime. Delaware v. Prouse holds that Grisham’s rights were violated as he was not suspected of having committed a crime prior to being detained. (h/t EJ)

We’re being conditioned to simply fear seeing a firearm. Personally, I think more people should open carry. In some circumstances it’s fine, in others, concealed carry is best.
